Welcome to myaiworkstaff.com. These Terms of Use ("Terms") govern your access to and use of the AI Workstaff website and services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.


1. Use of the Platform

1.1 Restrictions

You must be at least 18 years old to use the Platform. By accepting these Terms, creating a Platform Account, or using the Platform, you represent that you are at least 18 years old. You may not use the Platform or the Services if You are an employee, partner, or director of our Competitors or intend to gain access to the Platform in order to compete with the Platform.

1.2 Platform Account Ownership

Your use of the Platform is conditioned on your provision of complete, current, and accurate information when registering for a Platform Account. The Platform is intended for business use or in connection with an individual’s trade, craft, or profession. As the individual who accepts these Terms, You are the owner of the Platform Account unless You are acting on behalf of a business entity, in which case, the business entity is the owner of the Platform Account.

If You accept these Terms on behalf of a business entity, You represent and warrant that you have the authority to bind the business entity to these terms. In the event of a dispute regarding the ownership of a Platform Account, AI Workstaff reserves the right to request documentation to determine the rightful owner. AI Workstaff is not obligated to act as an arbiter or adjudicator of such disputes. Our determination, made in our sole discretion, will be final and binding on all parties.

1.3 Intended Use

You and your customers may use the Platform only as intended for lawful purposes and in accordance with these Terms. You agree that You and Your customers will not use the Platform in any way that violates any applicable law or regulation or engage in any Prohibited Uses. AI Workstaff reserves the right to monitor the use of the Platform by you and your customers.

1.4 Compliance

You will be solely responsible for your use of the Platform and Services, including (a) the quality and integrity of any data, (b) securing and maintaining proper insurance, and (c) compliance with all applicable laws and regulations including but not limited to HIPAA and other data privacy laws such as GDPR, CCPA, and all tax laws. AI Workstaff provides technology tools only and is not engaged in providing tax, accounting, or professional services advice.

1.5 Data Breach Notification

You are solely responsible for complying with all applicable data breach notification laws and regulations. In the event you discover a security incident affecting personal data processed through the Platform, you shall promptly investigate, take remedial measures, and make all legally required notifications to affected individuals and regulatory authorities.

1.6 Use of Communication Services

The Platform may include certain communications features such as SMS, MMS, email, voice call capabilities and other methods. Separate Communication Surcharges for these services may apply and will be charged to your invoice. Communication Surcharges are subject to the Leadconnector Terms of Service. Upon cancellation or termination of your Platform Account, all phone numbers procured through the Platform on your behalf will be released within fourteen (14) days.

By using our Communication Services, you agree that you are solely responsible for obtaining explicit 'prior express written consent' from your recipients as required by the TCPA and carrier guidelines. You agree that opt-in consent for SMS is not transferable and cannot be purchased or sold from third-party lists.

1.7 Platform Provider Role

You acknowledge and agree that AI Workstaff is a technology platform and communications service provider only. AI Workstaff provides the software infrastructure that enables you to send communications, but AI Workstaff does not initiate, create, send, or control the content, timing, or recipients of any communications. All communications sent using the Platform are created and initiated solely by you and/or your customers. You, and not AI Workstaff, will be deemed the “seller,” “telemarketer,” “advertiser,” or “sender” of all communications for all legal and regulatory purposes.

1.8 Your Telecommunications Compliance Obligations

You are exclusively responsible for all communications sent using the Platform and for compliance with all applicable federal, state, and international laws governing marketing, advertising, or communications. This includes, but is not limited to:

  • The Telephone Consumer Protection Act (TCPA)

  • The Telemarketing Sales Rule (TSR)

  • The CAN-SPAM Act of 2003

  • 10DLC registration and use requirements

You represent and warrant that you have obtained all necessary consents, permissions, and authorizations from recipients before contacting them using the Platform.

2. Payment and Taxes

2.1 Fees and Auto-Renewal

Your use of the Platform is subject to the timely payment of your and your customers’ Fees. By agreeing to these terms, you acknowledge that your subscription will automatically renew and your payment method will be charged the then-current rates without further authorization from You.

2.2 Wallets and Rebilling

Your Platform Account contains a “wallet” where you can pre-load funds for usage-based Fees, including Communication Surcharges. When your wallet balance falls below $10 USD, we will automatically charge the payment method on file to replenish your wallet to your pre-defined amount.


3. Intellectual Property

3.1 Platform Content

The Platform and Platform Content are the property of AI Workstaff or its licensors and are protected by copyright, trademark and other intellectual property laws. AI Workstaff grants you a personal, royalty-free, revocable, and non-exclusive license to access and use the Platform Content while using the Platform.


4. Limitation of Liability and Indemnification

4.1 Exclusive Remedy

Your exclusive remedy and our entire liability for any claims arising out of these Terms and your use of the Platform shall be limited to the amount you paid us for Services purchased on the Platform during the three (3) month period before the act giving rise to the liability.

4.2 Indemnification

You agree to defend, indemnify, and hold AI Workstaff harmless against all demands, claims, actions, or proceedings arising from your use of the Platform, including any breach of these Terms by you, your employees, or your customers.


EXHIBIT A: CODE OF CONDUCT

The following are considered Prohibited Uses of the Platform. Engaging in a Prohibited Use is a material breach for which AI Workstaff may immediately suspend or terminate your account:

  • Use of the Platform in any way that violates any applicable law or regulation.

  • Use of the Platform to transmit "spam," "junk mail," or any other similar solicitation.

  • Impersonating AI Workstaff, an employee, or another user.

  • Attacking the Platform via a denial-of-service attack.

  • Illegal or highly regulated goods or services content, or other activity that has a high risk of economic or physical harm, including but not limited to:

    • Cannabis/CBD/Vape

    • Debt consolidation or forgiveness

    • Multi-level marketing (MLM)

    • Credit repair services

    • Gambling or Payday lending.

    • Automatic determinations of eligibility for credit or employment.

    • Engaging in the unauthorized practice of law, medicine, or financial advice.


EXHIBIT B: ARTIFICIAL INTELLIGENCE POLICY

If you elect to use any AI-based features of the Platform, you acknowledge that:

  • AI Output May Be Inaccurate: The AI features may produce content that is inaccurate, incomplete, or offensive. AI Workstaff makes no warranty as to the accuracy of AI-generated content.

  • Review of Output: You are solely responsible for reviewing, editing, and validating all AI-generated content before its use or distribution.

  • Sensitive Information: You agree not to provide any sensitive personal information or Protected Health Information (PHI) as input into the AI features.

  • Transparency: You must disclose to your customers when they are interacting with an AI-based voice or chatbot.

SMS Messaging Terms & Compliance

1. Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with AI Workstaff through our website at https://myaiworkstaff.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.

2. Cancellation Instructions: You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

3. Support Information: If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to [email protected] or call during business hours.

4. Carrier Liability: Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.

6. Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

7. Age Restriction: You must be 18 years or older to participate in our SMS program.
